CRIANZA Y RESERVAS, SL, hereinafter “Bodega Aguilar”, with address at Avda. Alicante, 35 and CIF B53127916, registered in the Mercantile Registry of the city of Alicante Sheet number A-38715 Volume 1933, Folio 187, is the owner of the page www.aguilarbodega.es hereinafter “the e-commerce”.

1. E-commerce

1.1 BODEGA AGUILAR, online store operating from Spain, is dedicated to the online sale and distribution of spirits, liqueurs, beers, wines and soft drinks, among other alcoholic and non-alcoholic beverages. In the online store you can find different types and brands of wines (white, red and rosé), spirits (Whiskey, Rum, Gin, Vodka and Brandy), sparkling wines (Cava, Champagne and others), fortified wines (Jerez, Montilla and others), liqueurs and cocktail drinks (Frappes, special liqueurs, purées and syrups). In addition, you will find packs of different drinks.

General information of use.

2.1 The use of this e-commerce is exclusively for people over 18 years of age and therefore any user must make a sworn statement in this regard.

2.2 Although the e-commerce is accessible from anywhere in the world, the sale and distribution of the products will be only and exclusively for mainland Spain (Spain and Portugal) and Balearic Islands (excluding sales to Ceuta, Melilla, Canary Islands, Madeira and Azores).

2.3 Bodega Aguilar reserves the right to modify the contents, products or services marketed on its website, as well as commercial offers at any time.

2.4 Although we strive to have updated all the information displayed on our website, if there is a typographical error in any of the prices shown, the company reserves the right to cancel any order that included the product or service that included such error, letting the customer know as soon as possible to avoid prolonging the problem that could cause this incident. We understand by typographical error any price that is lower than the cost of the product and that will cause a loss to the company.

2.5 In the event that the information provided on any of our products does not correspond to the characteristics of the product, the customer shall have the right to cancel the purchase without any cost on his part.

2.6 Bodega Aguilar is not responsible for any of the information, contents, statements and expressions contained in the products marketed by the e-commerce, as well as the content of each of the beverages distributed, the responsibility will fall on the manufacturers, producers or distributors of these products. Therefore, the customer understands that Bodega Aguilar is a mere intermediary between him and such manufacturer or distributor.

Purchasing procedures

3.1 The purchase process is very quick and easy, the customer will simply select the product(s) he/she wishes to purchase and will have to add them to the shopping cart by clicking on the button provided for this purpose.

3.2 Once the products have been added to the shopping cart, the only thing left to do is to finalize the purchase by verifying the shipping details of the order, selecting the chosen payment method and making the payment. Once the payment has been made, the customer agrees to accept the order and receive it at the selected address.

Prices and Applicable Taxes

4.1 The prices of the products offered in the Ecommerce, include Value Added Tax (VAT). Purchases to be delivered within the peninsula, as well as in the Balearic Islands will be subject to VAT and the transaction currency is the EURO.

Form of Payment

5.1 In one of the last steps of the purchase process, the customer will choose the payment method that best suits him/her to purchase his/her purchases. Currently available methods are: payment by credit or debit card (Mastercard and Visa), transfer and Paypal. CRIANZA Y RESERVAS, SL, specifies to the holders of the card with which they make the transaction that it is responsible for the transactions. CRIANZA Y RESERVAS, SL, guarantees security thanks to the SSL Security Certificate, an information encryption system that guarantees the total security of your banking data. In this way, no one can share, decrypt, read, or copy the information transmitted.

5.2 If the company deems it appropriate and to prevent possible fraud, it may be given the possibility of requesting a specific form of payment or even reserves the right to cancel the order in the event that the identity of the buyer is not reliably accredited.

6.Shipment of products

6.1 E-commerce offers two shipping methods, normal and express. Delivery times, quality of service, and the cost of the service will depend largely on the delivery point/destination provided by the customer. These logistic services are performed by transport operators and not by Bodega Aguilar.

6.2 Orders will be shipped within 24-48 hours after receipt of payment if it is a normal shipment or within 14 hours after receipt of payment if it is an express shipment, through the company TIP-SA. This period begins to count if the payment is received before 17:00, otherwise it will be considered to have entered the next day. On weekends there is no delivery.

6.3 The customer will be able to check the status of his order with a tracking number provided by TIP-SA.

6.4 Shipping costs include handling and packaging costs, as well as transport costs. These costs may vary depending on the total weight of the package, however the website itself will inform you of the final shipping cost before accepting your order.

6.5 Bodega Aguilar will not be responsible for any damage to the package after shipment, but will endeavor to protect all fragile items with the best materials and best packaging practices to avoid as far as possible such incidents.

6.6 In any case, the company shall be responsible for claiming from the logistics company any damage caused in the transport of the goods. It is therefore essential that upon receipt of the goods you note on the delivery note of the carrier any anomaly you notice both in the packaging and in the contents of the goods. In this way, by noting these defects on the delivery note, the claim on our part will be more effective.

7.Customer Rights and Return Policy

7.1 Bodega Aguilar, does not guarantee the availability or delivery time of the products offered from the e-commerce, since there may be shrinkage in inventory or breakage at the time of preparation of orders. However, the company strives to keep inventories up to date to avoid this situation.

7.2 In the case of delivery times Bodega Aguilar has selected companies of the highest quality and reliability, but this is no guarantee that in any of the shipments may arise any unforeseen event and delivery may be delayed. In these cases Bodega Aguilar will not be responsible for such delay, although it will be provided to inform and assist the customer as an interlocutor between both parties.

7.3 Bodega Aguilar offers its customers the possibility to cancel their order at any time and at no cost provided that the cancellation is communicated before the order has been made available to the carrier for shipment. 7.4 If an order includes an erroneous product or a product different from the one added in the cart, it will be removed and the correct product will be delivered at no additional charge.

7.5 If a customer, once received the goods, wishes to return the products for personal reasons or for reasons unrelated to the service provided by Bodega Aguilar may do so after communicating via email(bodega@aguilargrupo.com) to customer service. The return period is 14 days from the date of receipt of shipment. This return operation will involve logistics costs to be borne entirely by the customer unless the package received does not correspond to the order placed. Once received the products, Bodega Aguilar will only refund the amount of the returned products provided that the condition of the boxes, products and labels returned are in perfect condition. The transportation cost paid in the original order will not be refunded since it is a service provided by the logistics agency.

7.5 For any incident related to the return of items from our e-commerce you must contact our Customer Service – After-sales staff via email: bodega@aguilargrupo.com who will inform and guide you through the process.

Customer Obligations

8.1 The Customer placing an order in Bodega Aguilar undertakes at all times to provide accurate information about the data requested in the registration form, and to keep them updated at all times.

8.2 The Customer accepts these general conditions contained in this contract. Bodega Aguilar, will provide the Customer with an identifier and password through the email provided.

8.3 The Customer undertakes to keep his personal access codes confidential and with the utmost diligence, given that any order placed on the e-commerce in his name will be attributed to the identified person.

8.4 Although in Bodega Aguilar we provide estimated delivery times, they could always be extended due to force majeure and the customer agrees to do his part to receive the goods and avoid additional logistics costs even after the estimated delivery date.

Security and Confidentiality

9.1 Bodega Aguilar guarantees security and confidentiality in all its transactions. All banking operations are carried out through a secure server, based on the SSL standard that protects the data.

9.2 All personal data provided by the Customer to Bodega Aguilar will be included in a personal data file created and maintained under the responsibility and compliance with the provisions of the General Data Protection Regulation RGPD and the law of Protection of Personal Data and Guarantees of digital rights LOPDGDD. 9.3 The Client may at any time exercise the rights of access, rectification, limitation, suppression, revocation of consent and portability of their personal data by sending an e-mail to administración@aguilargrupo.com.

Availability

10.1 Bodega Aguilar, as listed in its general conditions does not guarantee the continuous and permanent availability of the e-commerce service.

10.2 It is thus exonerated from any liability for any damages caused as a result of the lack of availability in its e-commerce. The technical team of Bodega Aguilar, will make every effort to inform the possible shutdown of the service with 24 hours in advance whenever possible.

10.3 Bodega Aguilar shall not be liable for the interruption, suspension or termination of the e-commerce service.

Order cancellations

11.1 Bodega Aguilar reserves the right to unilaterally cancel orders received with publication errors in prices or typographical errors.

12.Schedules

12.1 Bodega Aguilar through its e-commerce allows purchases to be made 24 hours a day throughout the year.

12.2 Our customer service hours are from 9:00 am to 1:30 pm and from 4:30 pm to 8:00 pm. From Monday to Friday. And Saturdays from 9 to 13.30 hours.

Applicable Law and Competent Jurisdiction

13.1 Purchases made in Bodega Aguilar are subject to Spanish law. In case of any conflict or discrepancy the competent jurisdiction shall be that established by Spanish law in its law of consumers and users.

14.Nullity and Ineffectiveness of Clauses

14.1 If any clause included in these General Conditions is declared, totally or partially, null or ineffective, such nullity or ineffectiveness shall only affect this provision or the part of the same that is null or ineffective, and the rest of these General Conditions shall remain in force, and such provision shall be considered totally or partially as not included.

15. Invoice order

15.1 If you as a customer would like to receive an invoice of your order, you may request it by contacting bodega@aguilargrupo.com within a maximum period of 14 days from the date of the order. If you exceed this period of 14 days, Bodega Aguilar can not guarantee the shipment of the same.
